TERMS OF SERVICE

Please read the following Terms of Service carefully before you agree to dog waste removal services from The Lawn Dogs.

The Lawn Dogs is an independently owned and operated business (“us,” “we” or “our”) that provides pet-waste removal services to residences, businesses and
corporate properties, you agree to the following terms of service (“Terms”) that govern the sales and services provided by us (“Services”). By accepting the Services you hire us for, you are bound to these Terms.

The customer understands our ability to provide the Services can be dependent on weather, condition of grass height, access to your yard which is your own responsibility, and other unknown outside influences.

DOG WASTE REMOVAL SERVICE

The Lawn Dogs offers residential and corporate pet waste removal services. These services include One Time Clean, Scheduled Cleaning, and Seasonal Cleaning. All pricing is based on an area size of an 1/8th of an acre. Larger areas may have an additional charge.

ACCESSING YOUR YARD

The Customer understands that if The Lawn Dogs can not access the area
needing cleaning due to locked/blocked/frozen gates or dogs in the yard; the scoop will be skipped and charges will still apply. The Lawn Dogs suggests adding gate combinations or lock keys to your file to avoid locked gates. If the customer requests we come back, a $5 driving fee will be added to the customer’s bill.

WEATHER

The Lawn Dogs will work through the rain and cold as long as we can safely
do so. The customer understands we cannot work through severe thunderstorms, high winds, extreme high or low temperatures, flooding or an accumulation of snow. The Lawn Dogs is a WEEKLY service. We do not offer refunds
for missed weeks due to weather. Therefore in these cases, we will skip service for that week, and see you the following week. A refund will not be issued as we still have to pick up all of the poop on our next visit that would have been scooped the prior week. If you need the area cleaned before your next scheduled service, please call us and we will do our best to accommodate, but cannot guarantee it. Additionally, we do not want to tear up your yard in any way. If it is excessively muddy, we may skip your yard and wait until the next scheduled visit when things have dried out.

AGGRESSIVE ANIMALS 

The Lawn Dogs will work with friendly animals in the yard; however, we will NOT work around aggressive animals. If we cannot access Client’s yard or complete a scooping because of an aggressive animal, Client will be notified and charged for the visit. If we are ever bitten by any animal, we will immediately leave the premise to seek medical attention. The yard will be left in “as is” condition and may be considered as ‘Services rendered’ for that visit. All medical fees will be the responsibility of the Client within a reasonable amount of time. Depending on the situation, Animal Control may be contacted and/or further actions may be taken. Client will maintain accurate and proper vaccination records for its dog(s) and make them available to Service Provider for inspection, if requested, or in the event of a dog bite/attack of a Service Provider employee. we rely on the Clients assessment of their animal’s temperament. Please consider this for the Service Provider’s safety. Service Provider reserves the right not to service any yard they don’t feel comfortable in.

CONSENT TO CONTACT

Cell Phone Calls/Text and Emails. By providing your cell phone number and/or email address, you consent to receiving such calls or electronic communications at the number or email address provided, including but not limited to, communication attempts (calls, text messages, emails or other electronic means) made by automated telephone dialing system, prerecorded messages or artificial voice. This consent is for Service Provider and any affiliates, including any and all third-party entities hired by Service Provider for billing, collections, or customer care services.

HOLIDAYS 

The Lawn Dogs does not provide services on the following holidays: Memorial Day, 4th of July, Labor Day, Thanksgiving Day, Christmas Day and New Year’s Day. If your pick up day falls on one of these days, we will skip service that week and pick up the following week. There are no refunds for a missed pick up. We still have to do the work on our next scheduled visit and pick up all of the poop from the week prior.

BILLING

The Lawn Dogs bills at the end of the day for our service. Your account will be charged at the end of the business day. If your card is declined, we will discontinue service immediately until the issue has been resolved. If more than 30 days have passed since your last clean up, a first time clean up fee will be applied. We will only pause service for periods of 30 days. If service does not resume after the 30 day period you will be removed from the schedule. One Time Cleanings will be billed after the service has been completed. Payment is due within 24 hours. If payment becomes more that 30 days late The Lawn Dogs will turn your account over to collections.

REFUNDS

Service Provider does not offer refunds for payment of Services unless the reason is an error on our part. If a refund is to be given for any reason, other than the fault of our own, refunds will be given minus bank/credit card processing fees and any proration of services, if relevant. Account credits may be given on a case-by-case basis and they will either reflect on the following month’s invoice or remain on Client’s account without expiration.

SATISFACTION GUARANTEE

If for any reason, Client is not completely satisfied with any Service the Client receives, The Lawn Dogs will do its best to revisit the same day. Revisit requests must be made within 24 hours after completion of the last Service, after which all work is final and no revisits will be provided free of charge. Service Provider always does its best to work with Client to resolve any issue to Client’s satisfaction within the guidelines of these Terms of Service.

LEAVES, DEBRIS AND TALL GRASS

We will always do our best to clean your yard the best that we can. We understand that maintaining your yard is a lot of work and it may not always be in the best shape. The customer understands that it can be very difficult to find dog poop in tall grass or in a yard full of leaves or other debris. If your grass is tall when we come, there may be some dog waste that is missed. We will be back on our next scheduled visit and will get anything that was missed if yard maintenance is complete. ADDITIONAL FEES

The following are items we charge extra for:

  • Removing dog waste from decks/patios/sidewalks ($5/visit)
  • Come Back request ($5/time)
  • Cleaning rocks/pebbled areas ($5/visit)
  • Waiting- If you make us wait to perform your cleaning ($5/visit)

REVISIONS

The Lawn Dogs provides the above Services to you subject to the Terms, which may be amended from time to time without notice to you. Amendments will be
effective upon our posting of such updated Terms to our website. We recommend you visit the Sites to review any changes in our practices. Your continued use of our Services shall constitute acceptance to any changes to the Terms. Some of the
provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

SHUT DOWN

We reserve the right to shut down operations fully between Christmas and New Years Day. You will be billed at your normal Monthly rate unless you scoop your yard fully during our shut down.

ADDITIONAL FEES

Late payment fee $10 added to each bill that is late. Payment is due the 1st of each month. Bill becomes late on the 3rd of each month.

WHAT PERSONAL DATA WE COLLECT AND WHY WE COLLECT IT

In common with other websites, log files are stored on the web server saving details such as the visitor’s IP address, browser type, referring page and time of visit. Cookies may be used to remember visitor preferences when interacting with the website. Where registration is required, the visitor’s email and a username will be stored on the server.

COMMENTS

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

MEDIA

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

CONTACT FORMS

If you submit a contact form on our site, the information related to the submission will be stored in our system & may be sent out to 3rd party vendors to assist us in serving you.

COOKIES

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. GOOGLE ADS

Google, as a third party vendor, uses cookies to serve ads. Google’s use of the DART cookie enables it to serve ads to visitors based on their visit to sites they visit on the Internet. Website visitors may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.

HOW LONG WE RETAIN YOUR DATA

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
